转运国际ZYGJ GLOBAL LLC(以下简称“本公司”),为依法在美国注册成立并合法运营的独立第三方国际转运及仓储服务公司,特此郑重声明如下
一、货物来源与交易独立性:
所有到达本公司的货物,均由客户自行购买、寄送或委托第三方发货。客户与任何供货商或其他第三方之间的采购、销售、付款或其他交易行为,均属客户与该第三方的独立商业往来,与本公司无关。本公司不参与、不介入、亦不承担客户与任何第三方之间的任何经济往来、采购、收款或结算行为所产生的法律责任。
Article 1. Independence of Goods and Commercial Transactions
All shipments received by the Company are purchased, shipped, or consigned independently by customers or their designated third parties. Any purchasing, selling, or payment activities between the customer and any vendor, supplier, or other third party are entirely independent commercial acts unrelated to the Company.The Company does not participate in, intervene in, or assume any liability for any procurement, payment, or settlement made by the customer to any such third party.
二、本公司与客户之间的关系
本公司与客户之间的交易关系仅限于物流服务行为,即客户向本公司支付运费或服务费,以换取运输、仓储、分拣、包装及其他相关操作服务。本公司提供的系独立的物流服务合同,不构成任何代理、雇佣或合作关系。
Article 2. Nature of Relationship with Customers
The commercial relationship between the Company and its customers is strictly limited to logistics services, whereby the customer pays shipping or service fees in exchange for transportation, warehousing, handling, and related operational services. Such logistics transactions do not create any agency, employment, or partnership relationship between the Company and its clients.
三、业务范围与责任界限
本公司仅根据客户的书面或电子指令,提供包括但不限于拆箱分拣、称重、拍照、打包、仓储、出货、合箱、分箱及其他物流辅助服务。
上述操作仅为物流处理与包装目的,不构成对货物来源、内容或合法性的检验、认证、担保或责任承担。
Article 3. Scope of Services and Limitation of Liability
The Company acts only upon written or electronic instructions from the customer, providing services including but not limited to unpacking, sorting, weighing, photographing, repacking, warehousing, shipping, consolidation, splitting, and other logistical operations. These actions are performed solely for logistical handling and packaging purposes, and do not constitute any verification, authentication, guarantee, or assumption of responsibility regarding the goods’ origin, content, or legality.
四、法律义务与中立立场
本公司不具备、亦无任何法定义务去检查、验证或监管客户所寄送物品的性质、来源或用途。
所有寄送及交易行为的合法性及其后果,均由客户自行承担全部责任。
本公司始终保持中立、独立且不介入客户交易关系的服务立场。
Article 4. Legal Obligations and Neutral Position
The Company has neither the capacity nor the legal duty to inspect, verify, or supervise the nature, source, or intended use of any shipment.All shipping and transactional activities remain the sole legal responsibility of the customer, while the Company maintains a neutral, independent, and non-involved role throughout the service process.
五、公司性质与法律声明
本公司以独立第三方物流服务提供商(Neutral Third-Party Logistics Provider)身份运营。
本公司不参与客户的任何采购、收款、付款、销售、售后或资金往来活动,亦不承担因此引起的任何纠纷、争议或法律责任。
Article 5. Company Status and Legal Disclaimer
The Company operates exclusively as a Neutral Third-Party Logistics Provider. It does not participate in any customer procurement, payment, collection, sale, or after-sales transactions, and shall not be held liable for any dispute, investigation, or legal consequence arising therefrom.
总则
用户在使用转运国际提供的各项服务之前,应仔细阅读本服务协议,如用户不同意本服务协议,可以主动取消转运国际提供的服务;用户在使用转运国际提供的各项服务的同时,承诺接受并遵守各项相关规则的规定。转运国际有权根据需要不时地制定、修改本协议或各类规则、如本协议有任何变更,转运国际将在网站上刊载公告,通知用户。如用户不同意相关变更,必须停止使用“本服务”。经修订的协议一经在转运国际公布后,立即自动生效。各类规则会在发布后生效,亦成为本协议的一部分。
登录或继续使用“本服务”将表示用户接受经修订的协议。除另行明确声明外,任何使“本服务”范围扩大或功能增强的新内容均受本协议约束。
用户在签署本服务协议前,务必认真阅读全部服务协议内容,如有任何疑问,可向转运国际咨询。用户点击协议正文下方的“确认”按钮并按照转运国际注册程序成功注册为用户,视为与转运国际签署了本服务协议,并同意接受协议约定的内容,本服务协议即在协议方之间产生法律效力。
General Provisions
Before using any services provided by Transship International, users should carefully read this Service Agreement. If a user does not agree with this Service Agreement, they may choose to discontinue using the services provided by Transship International. By using Transship International’s services, users agree to comply with and be bound by all relevant rules and regulations. Transship International reserves the right to formulate or modify this Agreement or various rules at any time as needed. If there are any changes to this Agreement, Transship International will post an announcement on the website to notify users. If a user disagrees with any changes, the user must stop using the “Service.” The revised agreement will automatically take effect as soon as it is published by Transship International. All rules become effective upon publication and also constitute part of this Agreement.
By logging in to or continuing to use the "Service," the user is deemed to accept the revised agreement. Unless expressly stated otherwise, any new content that expands the scope of the “Service” or enhances its functions will also be subject to this Agreement.
Before signing this Service Agreement, users must carefully read the entire content of the agreement. If there are any questions, users may consult Transship International. By clicking the “Confirm” button below the text of the agreement and successfully registering as a user according to Transship International’s registration procedures, the user is deemed to have signed this Service Agreement with Transship International and agrees to be bound by its terms. This Service Agreement then becomes legally effective between the parties.
注册信息和隐私保护
1.用户不得将会员资格出借、转让、买卖、抵押等;
2.用户不应将其帐号、密码转让或出借给他人使用,由于用户自己对帐号的保管不当、不安全操作或使用所造成的一切纠纷和后果,由用户自行承担,转运国际不承担任何责任。如用户发现其帐号遭他人非法盗用、使用或发生其他危及账户安全的情形,应立即书面通知转运国际,要求暂停或终止相关服务,转运国际将在合理时间内进行处理,但对在采取行动前已经产生的后果(包括但不限于用户的任何损失)不承担任何责任;
3.用户应提供及时、详尽及准确的个人资料,并不断更新注册资料,符合及时、详尽、准确的要求。所有原始键入的资料将引用为注册资料。如果因注册信息不真实而引起的问题,对问题发生所带来的后果,转运国际将不负任何责任;
4.转运国际遵循隐私政策保护个人信息,不向第三方提供具有可识别性的个人信息;
5.转运国际保留核实用户真实性的权力,对于拒绝提供有效身份证明,购物凭据的用户,转运国际有权关闭用户账户,拒绝提供服务;
6.同一用户不得重复或者恶意注册多个账户,如果发现此类问题,转运国际有权关闭用户账户并保留追究的权利;
Registration Information and Privacy Protection
1:Users are not permitted to lend, transfer, sell, or pledge their membership credentials.
2:Users must not transfer or lend their account or password to others. Any disputes or consequences arising from improper account management, unsafe operations, or usage are the sole responsibility of the user, and Transship International assumes no liability. If a user discovers that their account has been illegally stolen, used, or faces other security threats, they must immediately notify Transship International in writing and request to suspend or terminate related services. Transship International will handle such requests within a reasonable time but is not responsible for consequences (including but not limited to any losses incurred by the user) that occurred prior to taking action.
3:Users must provide timely, detailed, and accurate personal information and continuously update their registration details to meet those requirements. All information originally entered will be considered registration information. If issues arise due to false registration information, Transship International will not be held liable for any consequences resulting from those issues.
4:Transship International adheres to its privacy policy to protect personal information and will not provide personally identifiable information to third parties.
5:Transship International reserves the right to verify user authenticity. Users who refuse to provide valid identification or purchase documentation may have their accounts closed and services refused by Transship International.
6:The same user is not allowed to register multiple accounts repeatedly or maliciously. If such behavior is discovered, Transship International reserves the right to close the user’s account and pursue accountability.
责任范围和责任限制
1.非购买保险的托运货物发生丢失、损毁、短少时,按照本公司官方网站(www.zygjex.com)公布的理赔规则赔付。购买保险的,按照本公司官方网站公布的保险赔付规则赔付,本公司不承担任何间接、附带、特殊或衍生的损失(包括但不限于收入或利润损失)所产生。
2.本公司不会就下列原因造成的托运货物遗失、损毁、延迟送达、误送、未送达承担任何责任,亦不对因下述任一情况而导致用户的任何损害赔偿承担责任,包括但不限于利润、商誉、使用、数据等方面的损失或其它无形损失的损害赔偿,亦不采取任何运费调整、退款或任何补偿行为;
1、因用户、托运货物所有人、承运人不履行责任或疏忽造成的;
2、因托运货物的本质或瑕疵、特性或固有缺陷,如有明显破损等:
3、用户违反本公司所签发的运单、本条款、服务指南、或其它协议等,包括但不限于货物申报不实,寄运货件的包装、安全保障、标志或地址书写不当或不完整;
4、发生空难事故、公敌入侵、政府当局、法律权限、海关或检疫所官员的行为或疏忽、暴动、罢工或其它地区性争执、民众骚乱、战争或天气所带来的危险、或由非本公司所能控制事项所致的全国性或区域性空中或地面交通系统中断或通讯系统干扰或故障。在此情况下,本公司仍会尽合理的努力,尽快运送至目的地并完成送件。但我们没有义务在出现此类情况时向用户发出通知;
5、本公司遵循用户或其他寄、收件人的口头或书面送件指示行为导致;
6、如果包裹在送达时无破损且基本完整、收件人未提出异议并发出书面破损记录,寄件人包装并封口的包裹内发生遗失或损毁;
7、因清关手续或其它主管机关规定手续所致的延误;
8、因用户没有及时确认关税及税金支付所致的延误;
9、磁带、文件或其它存储媒体中数据的消除、或曝光底片中照相影像或音带地消除;
10、外包装完好,内件破损的包裹;
11、易碎品的破损及损坏,包括但不限于玻璃陶瓷材料及其制品,乐器,电子设备元件,照相器材等;除要求加固增值服务后依然导致破损情况外;
12、发件人或者购物网站未能提供能够支持多次转运需要的包装而造成的毁损;
13、提供错误、不完整、不正确或遗漏的地址信息,无法联系收件人,造成的重复配送所产生的费用及相关的后果,我们将不承担责任;
14、货物入库超过90天未提交运单发货,系统自动移除包裹并做弃货处理。称重扣款后,如因余额不足导致的延误登机,仓库在等待30天后如依旧没有选择付费发货,则美国仓库将默认该包裹为用户自动放弃,系统会删除该单号。
Scope and Limitation of Liability
1、For shipped goods that are not insured, compensation for loss, damage, or shortage will be paid according to the claims rules published on the company's official website (www.zygjex.com). For insured shipments, compensation will follow the insurance claims rules posted on the official website. The company will not be responsible for any indirect, incidental, special, or consequential damages (including but not limited to loss of income or profit).
2、The company will not be liable for any loss, damage, delay, misdelivery, or nondelivery of goods resulting from the following causes. The company will also not be responsible for any damages, including but not limited to loss of profits, goodwill, use, data, or other intangible losses, nor will it provide freight adjustments, refunds, or any other compensation:
1、Failure or negligence to perform responsibilities by the user, owner of the goods, or carrier.
2、The nature, defects, characteristics, or inherent flaws of the shipped goods, such as visible damage.
3、Violation of the waybill, these terms, service guidelines, or any other agreement issued by the company, including but not limited to false declarations of goods, improper or incomplete packaging, safety protection, labeling, or address information.
4、Air accidents, enemy invasions, actions or negligence by government authorities, legal powers, customs or quarantine officers, riots, strikes, regional disputes, civil unrest, wars, weather-related hazards, or any nationally or regionally occurring interruptions or disturbances in air or ground transportation or communications systems that are beyond the company's control. Under such circumstances, the company will still make reasonable efforts to deliver promptly, but is not obligated to notify users in the event of such situations.
5、Actions taken in accordance with verbal or written delivery instructions from the user or other senders or recipients.
6、If the package arrives intact and essentially undamaged, and the recipient does not object or provide a written damage report, loss or damage inside a package packed and sealed by the sender.
7、Delays caused by customs clearance or other procedures required by authorities.
8、Delays resulting from the user's failure to timely confirm payment of duties and taxes.
9、Destruction or erasure of data from tapes, documents, or other storage media, or loss of
photographic images or sound from exposed film or audio tapes.
10、Packages with intact external packaging but damaged contents.
11、Damage or breakage of fragile items, including but not limited to glassware, ceramic products, musical instruments, electronic components, and photographic equipment; except where reinforcement and value-added services were requested and damage still occurred.
12、Damage resulting from the sender or shopping site failing to provide packaging suitable for multiple shipments.
13、Costs or consequences arising from providing incorrect, incomplete, inaccurate, or missing address information, or being unable to contact the recipient, leading to repeated deliveries, for which the company assumes no responsibility.
14、If goods remain in storage for more than 90 days without submitting a shipping order, the system will automatically remove and treat the package as abandoned. If shipment is delayed due to insufficient balance following weight deduction, and payment is still not made after 30 days, the US warehouse will consider the package as voluntarily abandoned by the user, and the system will delete the package tracking number.
索赔
1.对于托运货物或部分托运货物损毁、遗失(包括延误引起的货物腐烂或损坏)的索赔,寄件人必须在托运货物送达后 30 日向本司提出书面索赔申请,包含理赔申请表、购物发票或者证明、签收凭据。对于未能送件或错误送件的索赔,寄件人应自接受托运货物后 30日内向本公司提出书面申请,寄件人在超出索赔日期后提出索赔申请将不被受理。
2.收件人受领托运货物的收据上若无受领物品毁损的书面通知,应属托运货物是以良好状况送件的初步证据。对于异常包裹,收件人在签收的时候务必在签收单上注明,并且让快递员签字。货物到达指定地点,除用户或托运人特别声明由指定收货人签收外,货物到达地的门卫、同事、家人等代收人签收将一律视为本人签收,对于正常签收的包裹,本公司将不接受理赔申请。
Claims
1、For claims related to damage or loss (including damage due to delays, such as spoilage) of all or part of shipped goods, the sender must submit a written claim within 30 days of delivery, including the claim application form, purchase invoice or proof of purchase, and delivery receipt. For claims due to nondelivery or misdelivery, the sender must submit a written application within 30 days of accepting the shipment. Claims submitted after the deadline will not be accepted.
2、If the recipient’s receipt of the shipped goods does not include a written notice of damage, the shipped goods will be considered to have been delivered in good condition. For abnormal packages, the recipient must note this on the delivery form and have the courier sign it at the time of receipt. Unless the user or shipper has specifically declared that only a designated recipient may sign for the delivery, acceptance of goods by gatekeepers, coworkers, family members, or other representatives at the destination will be regarded as acceptance by the intended recipient. For normally received packages, the company will not accept any claims.
服务约定
1.托运人不得托运或在所托运货物中夹带国家禁止运输的物品;因违背此约定造成承运人的一切损失托运人须双倍赔偿;
2.托运人或收货人不得无故拒付任何服务费用。约定到达目的地付款的货物,托运人承担支付与托运物品有关费用的连带责任。托运人或收货人无故不支付费用的,承运人可以对承运货物行使处置权、留置权及其他补救性权利,由此而产生的后果由托运人或收货人承担;
3.承运人从货物收运时起到交付时止承担安全运输责任,在此期间若发生货物损坏、短缺、灭失、污染,承运人负赔偿责任;
4.凡因履行本协议或与本协议有关的争议,当事人可以通过协商或调解解决,协商或调解不成,任何一方均应向本公司所在地人民法院提起诉讼;
5.托运人务必如实地申报货物价值,申报价值需与收/发货人双方的交易价格相同。如因托运人瞒报、少报货值导致被海关退关或罚款,相关责任及费用概由托运人承担;
6.货运价格依承运人公布价格确定。该价格不包含接送货费、税金、政府规费以及由于托运人或收货人的原因而增加的其他费用;
Service Provisions
1、The shipper must not ship or include any items prohibited by national law in the shipment; if this provision is violated and causes any losses to the carrier, the shipper will be liable for double compensation.
2、The shipper or recipient must not refuse to pay any service fees without valid reason. For shipments designated for payment upon delivery at the destination, the shipper has joint liability for any costs related to the shipment. If the shipper or recipient refuses to pay fees without justification, the carrier may exercise rights of disposal, lien, or other remedies over the goods, and any resulting consequences shall be borne by the shipper or recipient.
3、The carrier is responsible for the safe transportation of goods from the time of acceptance to the time of delivery. If any damage, shortage, loss, or contamination occurs during this period, the carrier is liable for compensation.
4、Any disputes arising from or related to the fulfillment of this Agreement may be resolved through negotiation or mediation; if negotiation or mediation fails, either party may bring a lawsuit to the People's Court at the company's location.
5、The shipper must truthfully declare the value of the goods, and the declared value must match the transaction value between the sender and recipient. If customs returns or fines occur due to underreporting or false declarations by the shipper, all related responsibilities and expenses will be borne by the shipper.
6、Freight charges are based on the rates published by the carrier. These rates do not include pick-up or delivery fees, taxes, government fees, or any additional costs incurred due to the actions of the shipper or recipient.
禁止托运的货物
1.现金及支票、汇票、证券以及其他有价证券类;
2.信用卡、现金卡、礼品卡等卡类;
3.金融机关的存折以及现金提款卡;
4.包裹上的送达地不易识别;
5.活的动植物、死的动物或剥制的动物(即标本);
6.人体或人体的一部分、遗体、遗骨、牌位;
7.兴奋剂、大麻、麻药、作用于中枢神经影响精神状态的药物以及其他违禁药物;
8.枪炮、刀剑、武器、兵器、火药类、爆炸物、有毒物、有毒化学物品;
9.医药品、医疗器械;
10.儿童色情画、成人色情录像带以及其他淫秽物品;
11.其运送、进出口受包括经由国在内的进出口国、州、地方自治体的法令禁止或限制的物品;航空、运输公司的运输协议中不允许承运的其他物品;
12.不适合进行托运的其他物品;
Prohibited Items for Shipment
1 Cash, checks, drafts, securities, and other negotiable instruments
2 Credit cards, cash cards, gift cards, and similar cards
3 Bankbooks and ATM cards issued by financial institutions
4 Parcels with an unrecognizable destination address
5 Live animals or plants, dead animals, or taxidermy specimens
6 Human bodies or body parts, remains, ashes, or memorial tablets
7 Stimulants, marijuana, narcotics, drugs affecting mental states via the central nervous system, and other prohibited substances
8 Guns, firearms, swords, weapons, ammunition, explosives, toxic substances, and hazardous chemicals
9 Pharmaceuticals and medical devices
10 Child pornography, adult pornographic videotapes, and other obscene materials
11 Items prohibited or restricted by any laws or regulations of the destination country, transit country, state, or local government; items not permitted under air or transportation company agreements
12 Any other items unsuitable for shipment
禁止行为
用户在使用本服务中,不得有属于或有可能属于以下任何一项的行为。
1.以不正当的目的使用本服务的行为;
2.侵害本公司以及第三方的商标权、著作权、外观专利权、发明专利权等知识产权以及肖像权、广告宣传权以及其他权利;
3.涉及欺诈等犯罪的行为;
4.伪装第三方使用本服务的行为;
5.不正当地使用本公司以及第三方的设备,或阻碍运营的行为;
6.违反法令、本协议或个别协议,以及违反公共秩序和社会道德的行为;
7.妨害本服务运营的行为;
8.公司认为不符合规定的其他行为;
9.医药品、医疗器械;
用户违反上述约定,转运国际可视情节轻重给予暂停服务或停止服务;用户行为涉及触犯法律,将移交相关部门处理;给本公司造成损失的,本公司将要求用户进行赔偿。
Prohibited Conduct
While using this service, users must not engage in, or attempt to engage in, any of the following acts.
1 Using the service for improper or unlawful purposes
2 Infringing upon the trademark rights, copyrights, design patents, invention patents, or other intellectual property rights, as well as image rights, publicity rights, or other rights of the company or third parties
3 Engaging in fraudulent or other criminal activities
4 Impersonating a third party in order to use the service
5 Improperly using the equipment of the company or third parties, or obstructing their operations
6 Violating laws, this agreement or individual agreements, or acting against public order and social morals
7 Disrupting the operation of this service
8 Any other acts deemed inappropriate by the company
9 Pharmaceuticals and medical devices
If users violate the above provisions, Transship International may, according to the severity of the situation, suspend or terminate services. If a user’s conduct violates legal regulations, the case will be referred to the relevant authorities. If the company suffers any loss as a result, the company will seek compensation from the user.
其他
1.本协议的执行、解释及争议的解决均应适用中华人民共和国法律;
2.如双方就本协议内容或其执行发生任何争议,双方应尽量友好协商解决;协商不成时,任何一方均可向本公司所在地的法院提起诉讼;
3.本公司未行使或执行本服务协议任何权利或规定,不构成对前述权利或权利之放弃。如本协议中的任何条款无论因何种原因完全或部分无效或不具有执行力,本协议的其余条款仍有效并且有约束力。
Miscellaneous
1 The execution, interpretation, and resolution of disputes under this Agreement shall be governed by the laws of the People’s Republic of China.
2 If any disputes arise between the parties regarding the content or performance of this Agreement, both parties shall attempt to resolve them amicably through negotiation; if negotiation fails, either party may file a lawsuit with the court located at the company’s place of business.
3 The company’s failure to exercise or enforce any right or provision of this Service Agreement does not constitute a waiver of those rights or provisions. If any clause in this Agreement is found to be wholly or partially invalid or unenforceable for any reason, the remaining clauses of this Agreement shall remain valid and binding.
